ORDER OF BUSINESS
The regular meeting of February 15, 1999, having been duly publicized, was called to order at 7:00 P. M. by Mayor Jones.
Mike Lovett, of Victory Baptist Church, rendered the invocation, and Mayor Jones led in the Pledge of Allegiance.
Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, Smith, and Sullivan. Councilmember Mottel was absent due to illness in his family.
Also in attendance were Charles B. Martin, City Administrator; Kelly F. Zier, City Attorney; John R. Brooks, Director of Leisure Services; George M. Grkovic, Director of Economic and Community Development; John P. Potter, Director of Finance; Thomas C. Zeaser, Director of Public Works; and Leona J. Lewis, City Clerk.
The minutes of the regular meeting and study session of February 1, 1999, were approved as presented by general consent.
ITEM 1. PUBLIC SAFETY: ROYALETTE AVENUE - CITIZEN CONCERN.
Ms. June Collier, who owns property located on Royalette Avenue, complained to Council that people were using the "right-of-way" belonging to the City at the back of the properties on Royalette Avenue as a thoroughfare, including driving vehicles, bicycles, etc. through the area. Ms. Collier also complained that people were sleeping in that area and using drugs. Ms. Collier also asked Council to do something about people leaving their garbage cans at the street.
Mayor Jones advised Ms. Collier that he would ask the Public Safety Department to investigate the situation to determine what the City might be able to do about the problem, and he would report back to her.
ITEM 2. VIDEO POKER: INQUIRY OF COUNCILMEMBER MCDOWELL.
Councilmember McDowell asked Council what the City can do about the property behind the Smile gas station on West Martintown Road and the rumor that a video poker establishment was locating there. City Attorney, Kelly Zier, advised Council that, since the property is not within the City limits, City Council cannot prevent the location of a video poker business at that location.
ITEM 3. UTILITIES: WATER TREATMENT PLANT & DISTRIBUTION SYSTEM IMPROVEMENTS - AUTHORIZE SOLICITATION OF BIDS - RESOLUTION.
On motion by Councilmember McDowell, second by Councilmember Sullivan, Council unanimously adopted a resolution authorizing solicitation of bids for the 6 mgd expansion of the City’s water treatment plant and scheduling distribution system improvements.

RESOLUTION NO. 99-05
AUTHORIZING SOLICITATION OF BIDS FOR A
6 MGD EXPANSION OF THE CITY OF NORTH AUGUSTA
WATER TREATMENT PLANT AND TO SCHEDULE
DISTRIBUTION SYSTEM IMPROVEMENTS
WHEREAS, as a result of current demands and anticipated future growth of the North Augusta water system, the City desires to increase its Water Treatment Plant capacity from its present eight million gallons a day (8 MGD) to fourteen million gallons a day (14 MGD) permanent capacity, to modernize the existing plant facilities, and to improve the City’s water distribution system; and
WHEREAS, on May 6, 1996, with adoption of resolution no. 96-11, City Council authorized a contract with B. P. Barber & Associates, the City’s consulting engineers for its water system, for the purpose of preparing a preliminary engineering report for the water treatment plant expansion; and
WHEREAS, on February 3, 1997, City Council, having reviewed a Preliminary Engineering Report for the 6 MGD plant expansion, authorized B. P. Barber to proceed with the final design for the water treatment plant expansion and modernization and to submit said plans to the South Carolina Department of Health and Environmental Control for its approval, and upon approval, to submit the plans to City Council for consideration to solicit bids for construction; and
WHEREAS, B. P. Barber has finalized the design for the water plant expansion, and DHEC has approved said design, and City Council has reviewed the design; and
WHEREAS, B. P. Barber completed a "Water Distribution System Study" dated December, 1998, and reviewed said study’s findings and recommendations for distribution system improvements with City Council on January 18, 1999.
NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council for the City of North Augusta, in meeting duly assembled and by the authority thereof, that B. P. Barber & Associates is hereby authorized to solicit bids for the proposed 6 MGD water plant expansion and upon receipt to submit said bids to City Council for consideration.
BE IT FURTHER RESOLVED that recommended distribution system improvements shall be included in scheduled improvement programs as contained within the attached "Utility Construction Fund – Project Cash Flow Sheet" dated February 1, 1999, and as, from time to time, updated.
BE IT FURTHER RESOLVED that the City Administrator is hereby authorized to sign all documents relating to the solicitation of bids.

ITEM 4. ZONING: 406 BARTON ROAD - C-3, GENERAL COMMERCIAL, TO 4-2, MEDIUM LOT SINGLE-FAMILY RESIDENTIAL - RECOMMENDATION OF PLANNING COMMISSION - RECEIVED AS INFORMATION.
On motion by Councilmember Baggott, second by Councilmember Carpenter, Council unanimously received as information the recommendation of the Planning Commission to rezone property located at 406 Barton Road, owned by Timothy R. Tinsley, from C-3, General Commercial, to R-2, Medium Lot Single-Family Residential.
ITEM 5. ZONING: 406 BARTON ROAD - C-3, GENERAL COMMERCIAL, TO 4-2, MEDIUM LOT SINGLE-FAMILY RESIDENTIAL - ORDINANCE, FIRST READING.
On motion by Councilmember McDowell, second by Councilmember Smith, Council unanimously passed on first reading an ordinance rezoning 406 Barton Road, owned by Timothy R. Tinsley, from C-3, General Commercial, to R-2, Medium Lot Single-Family Residential.

WHEREAS, Article I, entitled, "Administration," Section O, entitled, "Amendment Authorization and Procedure," of the Zoning and Development Standards Ordinance adopted November 18, 1996, provides a procedure for amending the official Zoning Map of the City of North Augusta; and
WHEREAS, said procedure has been followed, and the North Augusta Planning Commission recommends to the City Council of North Augusta the following amendment to the official Zoning Map.

ITEM 7. ZONING: WEST MARTINTOWN ROAD - SAVANNAH PARK APARTMENTS - GENERAL DEVELOPMENT PLAN - RECOMMENDATION OF PLANNING COMMISSION - RECEIVED AS INFORMATION.
On motion by Councilmember Baggott, second by Councilmember Carpenter, Council unanimously voted to receive as information the recommendation of the Planning Commission to approve the General Development Plan for the 48.9± acre Savannah Park Apartments planned development located on the south side of West Martintown Road near the intersection of Gregory Lake Road.
ITEM 8. ZONING: WEST MARTINTOWN ROAD - SAVANNAH PARK APARTMENTS - GENERAL DEVELOPMENT PLAN - ORDINANCE, FIRST READING.
On motion by Councilmember Sullivan, second by Councilmember McDowell, Council unanimously passed an ordinance on first reading approving the General Development Plan for the 48.9± acre Savannah Park Apartments planned development located on the south side of West Martintown Road near the intersection of Gregory Lake Road.
Mr. Roland Crawford, of Piedmont Foundation, advised Council that, since the Piedmont Foundation has received Federal low-income housing tax credits, the first phase of the development is designed for persons 55 years and older.

TO APPROVE THE GENERAL DEVELOPMENT PLAN
FOR THE 48.9±
ACRE SAVANNAH PARK APARTMENTS
PLANNED DEVELOPMENT LOCATED
ON THE SOUTH SIDE OF WEST MARTINTOWN ROAD
NEAR THE INTERSECTION OF GREGORY LAKE ROAD
WHEREAS, within the guidelines of the North Augusta Zoning and Development Standards Ordinance, a General Development Plan for property within a designated Planned Development zone (PD) requires Planning Commission review and subsequent recommendation to City Council for review and approval; and
WHEREAS, an application has been received from the Piedmont Foundation (developers) and Brandenburg Properties (property owners), requesting approval for a General Development Plan for a tract of land zoned Planned Development (PD) containing 48.9 ± acres located on the south side of West Martintown Road generally across from the intersection of Gregory Lake Road with West Martintown Road; and
WHEREAS, the developers, the Piedmont Foundation of Alpharetta, Georgia, proposes to construct 456 apartment units in three phases between January, 1999, and December, 2000. The first phase, Savannah Park, consists of 72 units (36 two-bedroom units and 36 three-bedroom units) and received an allocation of Federal low-income housing tax credits from the South Carolina Housing Finance and Development Authority for elderly housing. The Piedmont Foundation has purchased the ten acres in phase 1 from Brandenburg Properties. Phases 2 and 3, 216 units on 20 acres and 168 units on 19 acres respectively, will be called Savannah Ridge Apartments and are proposed to be market-rate rental units. The Piedmont Foundation has obtained an option to purchase the 39 acres in phases 2 and 3 from Brandenburg Properties; and
WHEREAS, the North Augusta Planning Commission, at its January 28, 1999, regular meeting, reviewed the subject application and voted to recommend that City Council approve the General Development Plan for the 48.9± acre Savannah Park Apartments Planned Development.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:
A. The scope of development described in the General Development Plan for Savannah Park and described herein shall be the maximum level of development allowed. The land uses permitted in Savannah Park are limited to multi-family residential and shall not exceed the gross density described herein. Minor modifications to the development plans, program, and schedule, i.e. distribution of units, mix of units, number and location of buildings, development schedule, setbacks, parking, and landscaping, may be approved administratively pursuant to Section 3.h.10. of the Zoning and Development Standards Ordinance.
B. If any portion of the project is sold or otherwise transferred in a manner that significantly changes the planned operation, management, or use of the project, a review and approval of the change by the Department of Economic and Community Development and the Planning commission shall be required prior to the approval of any subsequent site plan or building permit.

D. Amenities included in each parcel and phase of the development are:
E. General design criteria and development standards applicable to each phase of the development shall be as prescribed in Sections 3.h.7., 7.f. and 7.d. and as may be amended of the Zoning and Development Standards Ordinance.
F. The roadway classification and design of Savannah Park Drive and Savannah Ridge Drive shall be as shown on the General Development Plan. Detailed design and construction shall be in accordance with the City of North Augusta Construction Standards and Specifications and approved by the City Engineer at the site plan approval stage for each phase.
G. additional right-of-way adequate for deceleration/acceleration and/or turning movement lanes along the entire West Martintown Road frontage shall be reserved in the form of additional buffer depth. The determination of the amount of necessary additional buffer depth, if any, will be made concurrent with the site plan review for Phase 1.
II. All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
III. This Ordinance shall become effective immediately upon its adoption on third reading.
