ORDER OF BUSINESS

Mayor Jones announced that he would read a statement regarding the recent death of Keenan O’Mailia.

"On behalf of the City of North Augusta and its citizens, I want to extend our deepest sympathy to the family of Keenan O’Mailia. The tragic events of this weekend have shocked and disturbed all of us. Our prayers, concerns and efforts began before the child was found, and they will continue for his family, those involved in the investigation, and our community as a whole.

"Secondly, I want to express appreciation to the Department of Public Safety for their efforts. To SLED, other area departments, those who brought food and drinks, the reserve unit, and especially our community volunteers. You prove that our community is everything we say it is.

"I want our community to know that business will continue as usual. This is a time for prudence and precaution--not a time for panic. While this crime did not take place in Riverview Park, I recognize that people are concerned. People should be concerned as all of us are. The parks and Greeneway of North Augusta will remain open and regularly patrolled. North Augusta is a very safe community, but it is not exempt from the tragedies that permeate American society as a whole. I will continue to use all facilities of North Augusta on a regular basis with the good old common sense that most all of us have always used.

"Our Department of Public Safety will do everything possible to see that the person responsible for this crime is brought to justice. In the meantime, we ask that anyone with any information which may assist in this investigation, no matter how trivial they may think it is, please contact the Department.

PUBLIC HEARING

1. PLANNING: CULTURAL & NATURAL RESOURCES ELEMENTS OF THE COMPREHENSIVE LAND USE & DEVELOPMENT PLAN.

Having been duly advertised, a public hearing was held on Monday, April 19, 1999, at 7:00 P. M. for the purpose of receiving public comment on the proposed Cultural and Natural Resources elements of the City’s Comprehensive Land Use and Development Plan and official City map. Skip Grkovic, Director of Economic & Community Development, discussed the recommended plan elements.

Members present were Mayor Jones and Councilmembers Baggott, McDowell, Mottel, Smith, and Sullivan.

There being no citizen comments pro or con, the public hearing adjourned.

 

REGULAR MEETING

The regular meeting of April 19, 1999, having been duly publicized, was called to order at the conclusion of the public hearing by Mayor Jones.

Father Sandy McDonald, of Our Lady of Peace Catholic Church, rendered the invocation, and Mayor Jones led in the Pledge of Allegiance.

Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, Mottel, Smith, and Sullivan.

Also in attendance were Charles B. Martin, City Administrator; Kelly F. Zier, City Attorney; John R. Brooks, Director of Leisure Services; George M. Grkovic, Director of Economic and Community Development; John P. Potter, Director of Finance; T. Lee Wetherington, Director of Public Safety; Thomas C. Zeaser, Director of Public Works; and Leona J. Lewis, City Clerk.

The minutes of the regular meeting of April 5, 1999, were approved as presented by general consent.

ITEM 1. ANNEXATION: 3.42± ACRES - INTERSTATE 20 & WEST MARTINTOWN ROAD - JOSEPH B. KINSEY & GREAT GAMES OF NORTH AUGUSTA, INC., - RESOLUTION TO ACCEPT PETITION.

On motion by Councilmember Mottel, second by Councilmember McDowell, Council unanimously adopted a resolution accepting a petition requesting the annexation of 3.42± acres of property located near the intersection of Interstate 20 and West Martintown Road owned by Joseph B. Kinsey (legal title owner) and Great Games of North Augusta, Inc. (equitable owner).

RESOLUTION NO. 99-10

TO ACCEPT PETITION FOR ANNEXATION OF PROPERTY

LOCATED NEAR THE INTERSECTION OF

INTERSTATE 20 AND WEST MARTINTOWN ROAD

OWNED BY JOSEPH B. KINSEY AND

GREAT GAMES OF NORTH AUGUSTA, INC.

WHEREAS, Section 5-3-150 of the Code of Laws of the State of South Carolina provides that: "Any area or property which is contiguous to a city or town may be annexed to the city or town by filing with the municipal governing body a petition signed by seventy-five percent or more of the freeholders owning seventy-five percent or more of the assessed valuation of the real property in the area requesting annexation. Upon the agreement of the governing body to accept the petition and annex the area, and the enactment of an ordinance declaring the area annexed to the city or town, the annexation shall be complete;" and

WHEREAS, the governing body of the City of North Augusta determines it to be in the best interest of the City to accept a petition for annexation dated April 16, 1999, of the property described below:

Parcel One:

All that lot or parcel of land with all improvements thereon, situate, lying and being in Aiken County, South Carolina, near the intersection of Interstate 20 and Martintown Road, adjacent to the present City limits of North Augusta, South Carolina, starting at a point 37.5 feet from the center line of the Frontage Road and approximately 500 feet from Martintown Road, thence North 86° 15’45" East 51.86 feet; thence South 5° 13’28" West 502.11 feet; thence North 60° 22’00" West 251.35 feet; thence North 29° 42’33" East 428.70 feet to the point of beginning, containing 1.532 acres as shown on a plat prepared by William H. McKie, III, RLS, dated March 22, 1984, recorded in the Office of the RMC for Aiken County, South Carolina, in Misc. Book 925 at page 297.

Parcel Two:

All that lot or parcel of land with all improvements thereon, situate, lying and being in Aiken County, South Carolina, near the intersection of Interstate 20 and Martintown Road, adjacent to the present City limits of the City of North Augusta, South Carolina, starting at an iron pin approximately 500 feet from Martintown Road on Frontage Road, thence South 26° 49’36" East 442.75 feet; thence South 69° 32’45" West 99.67 feet; thence South 70° 11’45" West 216.75 feet; thence North 5° 13’28" East 502.11 feet; thence North 86° 15’45" East 51.87 feet to the point of beginning, containing 1.895 acres as shown on a plat prepared by William H. McKie, III, RLS, dated March 22, 1984, recorded in the Office of the RMC for Aiken County, South Carolina, in Misc. Book 925 at page 297.

Said property is further delineated on a plat prepared by William H. McKie dated March 22, 1984, titled "Plat of Property Petitioned to be Annexed to the City of North Augusta, South Carolina."

Said property is identified by the following map parcel number:

NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of North Augusta in meeting duly assembled and by the authority thereof that the Petition to Annex the property described herein is hereby accepted.

DONE, RATIFIED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, ON THIS 19TH DAY OF APRIL, 1999.

 

ITEM 2. ANNEXATION: 3.42± ACRES - INTERSTATE 20 & WEST MARTINTOWN ROAD - JOSEPH B. KINSEY & GREAT GAMES OF NORTH AUGUSTA, INC., - ORDINANCE, FIRST READING.

On motion by Councilmember McDowell, second by Councilmember Sullivan, Council passed on first reading an ordinance to effect the annexation of 3.42± acres located near the intersection of Interstate 20 and West Martintown Road owned by Joseph B. Kinsey (legal title owner) and Great Games of North Augusta, Inc. (equitable owner). The property is to be used as a video gaming establishment. The property would be zoned C-5, Thoroughfare Commercial.

Voting in favor of passage of the ordinance were Councilmembers McDowell, Mottel, Smith, and Sullivan. Voting against passage of the ordinance were Mayor Jones and Councilmembers Baggott and Carpenter.

The property shall be zoned C-5, Thoroughfare Commercial, under the official Zoning and Development Standards Ordinance of the City of North Augusta and shown on the official Zoning Map as same, as shown on a plat attached hereto marked Exhibit "B" entitled "Zoning of Property Sought to be Annexed to the City of North Augusta, South Carolina."

III. This Ordinance shall become effective on third and final reading.

IV. All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.

ITEM 3. ANNEXATION: 3.42± ACRES - INTERSTATE 20 & WEST MARTINTOWN ROAD - JOSEPH B. KINSEY & GREAT GAMES OF NORTH AUGUSTA, INC., - ORDINANCE, SECOND READING - TABLED.

On motion by Councilmember Mottel, second by Councilmember Smith, passage of the subject ordinance was presented for discussion. Following discussion, a motion was made by Councilmember Smith, second by Mayor Jones, to table passage of the ordinance until the next regular meeting. Voting in favor of tabling the ordinance were Mayor Jones, Councilmembers Carpenter and Smith. Voting against tabling the ordinance were Councilmembers Baggott, McDowell, Mottel, and Sullivan. The motion to table failed.

A motion to reconsider tabling the ordinance was then made by Councilmember Sullivan, second by Councilmember Mottel. Voting in favor were Mayor Jones, Councilmembers Carpenter, McDowell, Mottel, Smith, and Sullivan. Voting against the motion was Councilmember Baggott. The motion to reconsider passed.

A motion to table second reading of the ordinance was then made by Mayor Jones, second by Councilmember Smith. Voting in favor of tabling the ordinance were Mayor Jones, Councilmembers Carpenter, McDowell, Mottel, Smith, and Sullivan. Voting against tabling the ordinance was Councilmember Baggott. The motion to table passed.

 

ITEM 2. PERSONNEL: EMPLOYEE OF THE QUARTER - JANUARY, FEBRUARY, AND MARCH, 1999 - PRESENTATION.

Mayor Jones presented the Employee of the Quarter award to Diana Miller, Human Resources Specialist in the Administration Department. Diana was selected as Employee of the Quarter for January, February, and March, 1999, by the Employee Recognition Committee. The nomination letter follows:

The City of North Augusta Employee Recognition Committee would like to recognize the employee of the quarter for January-March 1999, Diana Miller, Human Resources Specialist.

Diana was nominated by Lee Wetherington, Director of Public Safety, and Captain Randy Mosley of the Public Safety Department.

Diana began work for the City of North Augusta on February 22, 1995 as an Administration Secretary. She was promoted to the new position of Human Resources Specialist on January 8, 1997. She performs various personnel, secretarial, and administrative functions for the City. Diana’s compassion for her fellow employees, her enthusiasm and her willingness to assist others are prime reasons why she is the employee of the quarter.

Congratulations to Diana Miller, our employee of the first quarter of 1999.

ITEM 3. MISCELLANEOUS - BOY SCOUTS, TROOP 7 - RECOGNITION BY MAYOR.

Mayor Jones acknowledged Boy Scouts of Troop 7 in attendance at the Council meeting and urged them to continue their efforts toward attaining an Eagle Scout badge.
