ORDER OF BUSINESS

The regular meeting of May 17, 1999, having been duly publicized, was called to order at 7:00 P. M. by Mayor Jones.

Reverend Jimmy Coyle, of Immanuel Baptist Church, rendered the invocation, and Mayor Jones led in the Pledge of Allegiance.

Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, Mottel, Smith, and Sullivan. Councilmember Carpenter left the meeting to attend another function following the vote on the item regarding annexation and was not present for the vote on the remaining items.

Also in attendance were Charles B. Martin, City Administrator; Kelly F. Zier, City Attorney; John R. Brooks, Director of Leisure Services; George M. Grkovic, Director of Economic and Community Development; John P. Potter, Director of Finance; Thomas C. Zeaser, Director of Public Works; Billy Luckey, Public Safety Captain; and Leona J. Lewis, City Clerk.

The minutes of the regular meeting and study session of May 3 and the study session of May 10, 1999, were approved as presented by general consent.

 

ITEM 1. ANNEXATION: 3.42± ACRES - INTERSTATE 20 & WEST MARTINTOWN ROAD - JOSEPH B. KINSEY & GREAT GAMES OF NORTH AUGUSTA, INC. - ORDINANCE, THIRD AND FINAL READING.

On motion by Councilmember McDowell, second by Councilmember Sullivan, Council unanimously voted against an ordinance on third reading and in so doing denied the annexation of 3.42± acres located near the intersection of Interstate 20 and West Martintown Road owned by Joseph B. Kinsey (legal title owner) and Great Games of North Augusta, Inc. (equitable owner).

The following residents of North Augusta spoke in opposition to the annexation and urged Council to deny the annexation.

Randy Parks, 419 Cooper Mill Road.

Robert Ledbetter, 424 West Woodlawn Avenue.

Brenda Bancroft, 219 Jackson Avenue.

Jane Laube, 414 Kathryn Avenue.

 

ITEM 2. ECONOMIC DEVELOPMENT: SUPPORT FOR A NATIONAL CEMETERY AT FORT GORDON - RESOLUTION.

On motion by Mayor Jones, second by Councilmember Smith, Council unanimously adopted a resolution supporting the location of a national cemetery at Fort Gordon.

The resolution text follows:

RESOLUTION NO. 99-12

SUPPORTING A NATIONAL CEMETERY

AT FORT GORDON, GEORGIA

WHEREAS, nearly 90 thousand men and women in the greater CSRA of Georgia and South Carolina have served the United States in military service; and

WHEREAS, each of these solders, sailors, airmen, and Marines have made personal sacrifices to protect the freedom we all enjoy; and

WHEREAS, the Congress has established a system of national cemeteries as final resting places for thousands of those veterans; and

WHEREAS, the Veterans Administration is in the process of opening additional national cemeteries in various parts of the United States; and

WHEREAS, the Army has offered to donate property at Fort Gordon for the establishment of a national cemetery to serve the veterans in Georgia and South Carolina; and

WHEREAS, a national cemetery in the CSRA would allow survivors to remain in the community with their deceased loved ones and would be a place of honor for all veterans in the area.

NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council in meeting duly assembled and by the authority thereof that the City Council does hereby support the establishment of a national cemetery at Fort Gordon and requests members of the congressional delegations in Georgia and South Carolina to sponsor such legislation as may be necessary to accomplish this.

ITEM 3. FINANCE: BUSINESS LICENSE - INSURANCE - SUIT - AUTHORIZE REPRESENTATION - MOTION BY COUNCIL.

On motion by Mayor Jones, second by Councilmember Baggott, and in conjunction with the Municipal Association of South Carolina, Council authorized Ms. Frances Cantwell of the firm of Regan & Cantwell, to represent the City in a suit against GEICO, USAA, and any other delinquent "mail-order" insurance companies for the collection of business license taxes as may be lawfully due.

 

ITEM 4. FINANCE: PURCHASING PROCEDURES - REVISION - ORDINANCE, THIRD AND FINAL READING.

On motion by Councilmember Mottel, second by Councilmember Baggott, Council unanimously adopted an ordinance revising the City’s purchasing procedures.

ITEM 5. PLANNING: CULTURAL & NATURAL RESOURCES ELEMENTS OF THE COMPREHENSIVE LAND USE AND DEVELOPMENT PLAN - ADOPTION - ORDINANCE, THIRD AND FINAL READING.

On motion by Councilmember Sullivan, second by Councilmember McDowell, Council unanimously adopted an ordinance on third and final reading adopting the Cultural and Natural Resources elements of the City’s Comprehensive Land Use and Development Plan.

ITEM 6. PUBLIC WORKS: NATIONAL PUBLIC WORKS WEEK - PROCLAMATION.

Mayor Jones proclaimed the week of May 16-22, 1999, as National Public Works week in North Augusta.

The proclamation text follows:

PROCLAMATION

WHEREAS, public works services provided in our community are an integral part of our citizens’ every-day lives; and

WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation of public works systems and programs such as water, sewers, streets and highways, public buildings, and solid waste collection; and

WHEREAS, the health, safety, and comfort of this community greatly depends on these facilities and services; and

WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design, and construction is vitally dependent upon the efforts and skill of public works officials; and

WHEREAS, the efficiency of the qualified and dedicated personnel who staff public works departments is materially influenced by the people’s attitude and understanding of the importance of the work they perform.

 

NOW THEREFORE, I, Lark W. Jones, Mayor of the City of North Augusta, South Carolina, do hereby proclaim the week of May 16-22, 1999, as

NATIONAL PUBLIC WORKS WEEK

in the City of North Augusta, South Carolina, and I call upon all citizens and civic organizations to acquaint themselves with the issues involved in providing our public works and to recognize the contributions which public works officials make every day to our health, safety, comfort, and quality of life.

ITEM 7. STREETS & DRAINS: WEST BUENA VISTA AVENUE - CITIZEN COMPLAINT.

Mr. Paul Proveaux, 541 Grant Avenue, complained to Council about several problems along West Buena Vista Avenue--garbage cans being left at the street, cars parked on the sidewalk, and motorists speeding on Alta Vista Avenue. Mayor Jones asked staff to check out the situations and take corrective measures including placing speed indicator equipment on Alta Vista Avenue and Buena Vista Avenue.

 

ITEM 8. STREETS & DRAINS: U. S. HIGHWAY 1 FROM EAST MARTINTOWN ROAD TO SAVANNAH RIVER INTERCHANGE - PRELIMINARY DRAFT ENVIRONMENTAL ASSESSMENT - RECEIVED AS INFORMATION - RESOLUTION.

On motion by Councilmember Baggott, second by Councilmember Smith, the resolution to accept as information the report entitled, "Aiken/Augusta Highway Improvements - Preliminary Draft Environmental Assessment," and to select Alternative #5 as the preferred routing of the proposed improvements to U. S. Highway 1 was discussed by Council. A motion was made by Councilmember Mottel, second by Councilmember Baggott, to amend the resolution by adding "and alternative #6" where applicable in the resolution. The motion to amend the resolution carried unanimously. The vote was then taken on the original motion, and the resolution as amended was adopted unanimously.

RESOLUTION NO. 99-13

TO RECEIVE THE REPORT TITLED

"AIKEN/AUGUSTA HIGHWAY IMPROVEMENTS -

PRELIMINARY DRAFT ENVIRONMENTAL ASSESSMENT"

AS PREPARED BY LPA GROUP, INC.

WHEREAS, On February 17, 1997, City Council, with its adoption of resolution no. 97-04, authorized an agreement with the South Carolina Department of Transportation (SCDOT) for the initial phase for preparation of the design plans for the interchange along Aiken/Augusta Highway (U. S. Highway 1) from East Martintown Road to the Savannah River; and

WHEREAS, on September 15, 1997, City Council, with its adoption of resolution no. 97-29, selected the engineering firm of LPA Group, Inc., for the preliminary engineering for the redesign of the interchange; and

WHEREAS, LPA Group, Inc., has completed its work, identifying and assessing six alternative road system designs and evaluating each for potential environmental impacts, project costs, and impact to businesses and residences. LPA has submitted their report to and has discussed its findings with City Council.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council for the City of North Augusta that the report prepared by LPA Group, Inc., titled, "Aiken/Augusta Highway Improvements - Preliminary Draft Environmental Assessment" is hereby received as information.

BE IT FURTHER RESOLVED that, based upon the information contained in the subject report, alternatives #5 and #6 accomplish the safety, capacity, and traffic flow goals of the road network redesign. Furthermore, alternatives #5 and #6 relate well to riverfront development plans; provide for an orderly continuation of East Shoreline Drive from the River Club Subdivision tying into RiverNorth; protect the natural scenic buffer prior to entering into RiverNorth; address the East Martintown Road/East Buena Vista Avenue interchange in a simple, direct manner; is cost effective; will allow the overall design to be divided into smaller projects for better access to funding; and allow for needed flexibility when getting into the actual roadway design.

BE IT FURTHER RESOLVED that the currently closed Fifth Street approach viaduct is of no value to the City and that the South Carolina Department of Transportation shall be so notified and requested to remove said viaduct as soon as practical.

TO APPROVE THE GENERAL DEVELOPMENT PLAN

FOR THE 14.16± ACRE VILLAGE AT RIVERVIEW

PLANNED DEVELOPMENT LOCATED

WHEREAS, within the guidelines of the North Augusta Zoning and Development Standards Ordinance, a General Development Plan for property within a designated Planned Development zone (PD) requires Planning Commission review and subsequent recommendation to City Council for review and approval; and

WHEREAS, an application has been received from Crowell and Company, Inc., requesting approval for a General Development Plan for a tract of land proposed to be zoned Planned Development (PD) containing 14.16± acres located on the west side of the intersection of Alta Vista Avenue and Mokateen Road; and

WHEREAS, the developer, Crowell and Company, Inc., of Evans, Georgia, proposes to construct 76 single-family attached residential units on 21 parcels in one phase. Crowell and Company has obtained agreements to purchase or trade for all 14.16 acres with the current property owners including the City of North Augusta; and

WHEREAS, the North Augusta Planning Commission, at its April 25, 1999, regular meeting, reviewed the subject application and voted to recommend that City Council approve the General Development Plan for the 14.16± acre Village at Riverview Planned development.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:

  1. The General Development Plan for the 14.16± acre Village at Riverview Planned Development is hereby approved as outlined below and as shown on the attached plat as prepared by Southern Partners, Inc., dated March 8, 1999:

A. The scope of development described in the General Development Plan for the Village at Riverview and described herein shall be the maximum level of development allowed. The land uses permitted in Village at Riverview are limited to single-family attached residential and shall not exceed the gross number of units described herein. Minor modifications to the development plans, program, and schedule, i.e. distribution of units, mix of units, number and location of buildings, development schedule, setbacks, parking, and landscaping, may be approved administratively pursuant to Section 3.h.10. of the Zoning and Development Standards Ordinance.

D. General design criteria and development standards applicable to each phase of the development and not otherwise prescribed in the General Development Plan shall be as prescribed in Sections 3.h.7., 7.f. and 7.d., and as may be amended, of the Zoning and Development Standards Ordinance.

II. All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.

III. This Ordinance shall become effective immediately upon its adoption on third reading.
