ORDER OF BUSINESS

The regular meeting of July 19, 1999, having been duly publicized, was called to order at 7:00 P. M. by Mayor Jones.

Mayor Jones rendered the invocation and led in the Pledge of Allegiance.

Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, Mottel, Smith, and Sullivan.

Also in attendance were Charles B. Martin, City Administrator; Kelly F. Zier, City Attorney; George M. Grkovic, Director of Economic and Community Development; John P. Potter, Jr., Director of Finance; T. Lee Wetherington, Director of Public Safety; Thomas C. Zeaser, Director of Public Works; Diana H. The minutes of the regular meeting of June 21, 1999, and the study session meeting of July 12, 1999, were approved as presented by general consent.

ITEM 1. ANNEXATION: LAKES AND STREAMS - LAKE HARTWELL DRIVE,
PORTIONS OF LOT NO. 1101 - RESOLUTION TO ACCEPT PETITION

On motion by Councilmember Mottel, second by Councilmember Carpenter, Council unanimously adopted a resolution accepting a petition from Lakes and Streams Development Company requesting annexation of a portion of Lot No. 1101 of the Robin Lake Section of Lakes & Streams Subdivision.

TO ACCEPT PETITION FOR ANNEXATION OF

LOT NO. 1101 OF THE ROBIN LAKE SECTION

OF LAKES & STREAMS SUBDIVISION

WHEREAS, Section 5-3-150 of the Code of Laws of the State of South Carolina provides that: "Any area or property which is contiguous to a city or town may be annexed to the city or town by filing with the municipal governing body a petition signed by seventy-five percent or more of the freeholders owning seventy-five percent or more of the assessed valuation of the real property in the area requesting annexation. Upon the agreement of the governing body to accept the petition and annex the area, and the enactment of an ordinance declaring the area annexed to the city or town, the annexation shall be complete;" and

WHEREAS, the governing body of the City of North Augusta determines it to be in the best interest of the City to accept a petition for annexation dated June 23, 1999, of the property described below:

All those certain pieces, parcels or tracts of land, with improvements thereon, situate, lying and being in the County of Aiken, State of South Carolina, adjacent to the present City Limits of North Augusta, identified as a portion of Lot No. 1101 which is outside the City Limits of North Augusta, such lot being shown on plat prepared by Southern Partners for Lakes and Streams Development Company, said plat being titled "Record Plat of Part "A" of Robin Lakes of Lakes and Streams", dated 1-27-98 and being recorded in Plat Book 38, Page 50, Records of RMC of Aiken County, South Carolina, from which a more complete and accurate description of the metes, bounds and location of the premises can be determined.

On motion by Councilmember Smith, second by Councilmember McDowell, Council unanimously passed on first reading an ordinance to effect the annexation of a portion of Lot No. 1101 of the Robin Lake Section of Lakes & Streams Subdivision. The property is proposed to be zoned R-3, Single-Family Residential.

On motion by Councilmember McDowell, second by Councilmember Carpenter, Council unanimously adopted a resolution accepting a petition from Lakes and Streams Development Company requesting annexation of a portion of Lot No. 1102 of the Robin Lake Section of Lakes & Streams Subdivision.

On motion by Mayor Jones, second by Councilmember Baggott, Council unanimously passed on second reading an ordinance to effect the annexation of a portion of Lot No. 1110 of the Robin Lake Section of Lakes & Streams Subdivision. The property is proposed to be zoned R-3, Single-Family Residential.

ITEM 10. COMPREHENSIVE ANNUAL FINANCIAL REPORT (CAFR) - PRESENTATION - RECEIVED AS INFORMATION

On motion by Councilmember Mottel, second by Mayor Jones, Council unanimously voted to receive as information the Comprehensive Annual Financial Report (CAFR) for the year ending December 31, 1998.

Director of Finance John Potter briefly reviewed the three basic sections of the CAFR: (1) the introductory section provides general information on a government’s structure, personnel, economic situation, and finances; (2) the financial section provides information on both fund types and individual funds and account groups; and (3) the statistical section provides a broad range of trend data covering key financial indicators from the past ten fiscal years.

John Potter explained that the Government Finance Officers Association of the United States and Canada awards Certificates of Achievement for Excellence in Financial Reporting to governmental agencies who publish an easily readable and efficiently organized comprehensive annual financial report whose contents conform to program standards, generally accepted accounting principles, and applicable legal requirements.

The City has received a Certificate of Achievement for Excellence in Financial Reporting as a result of the City’s submission of the CAFR for the last 16 years. This report has been submitted to GFOA for review. The award results of this report will not be known until late 1999.

ITEM 11. SURPLUS PROPERTY - SALE OF SEDAN TO AIKEN COUNTY - APPROVAL BY COUNCIL

On motion by Mayor Jones, second by Councilmember Carpenter, Council unanimously approved the request of the Aiken County’s Sheriff’s Department to purchase a City vehicle, a 1993 Ford Crown Victoria, 2FACP71W4PX143488, 4100-90 (Fixed Asset #) for $4,000.00, which is the blue book price. The City code, Section 2-258, provides that the City Administrator may sell surplus property to other governmental agencies with the approval of City Council.

ITEM 12. JUSTICE AND LAW: CITY OF NORTH AUGUSTA, ET AL. VS. SCDJJ - RECOMMENDED SETTLEMENT, APPROVAL BY COUNCIL

On motion by Mayor Jones, second by Councilmember Smith, Council unanimously approved a settlement to the case "City of North Augusta, et al vs. SCDJJ" as recommended by the South Carolina Municipal Association and as outlined below. The motion further authorized the City Attorney to notify Danny C. Crowe of Turner, Padget, Graham, & Laney, P.A. of their approval of such settlement.

In 1995, the South Carolina Legislature passed legislation shifting the cost burden for utilizing the Department of Juvenile Justice’s detention facility in Columbia. Previously, costs for housing juveniles in this facility were borne by the counties.

The new legislation placed the responsibility on the law enforcement agency having original jurisdiction. For North Augusta, this meant that, if the Department of Public Safety arrested a juvenile, the City would be responsible for paying the costs associated with housing that juvenile. The most recent invoice from SCDJJ was $63.39/day.

Since the initial passage of this legislation, the cities and the Municipal Association have been working on first, trying to get the legislation rescinded, and second, trying to work out an agreement with the Department of Juvenile Justice where they would not impose the charge. As part of these efforts, many cities, in concert with the Municipal Association, joined together to oppose and withhold payment. Since 1995 until now, there has been an impasse.

On March 16, 1998 Council authorized the City to join with 62 other South Carolina cities and the Municipal Association of South Carolina in challenging SCDJJ’s right to charge for this service.

As of June 30, 1999, North Augusta had an outstanding bill of $31,094.27 for services rendered by SCDJJ.

As the case has progressed SCDJJ has prevailed in the lower court with the Municipal Association appealing to the State Supreme Court. A proposed settlement has now been proposed with the recommendation of the Municipal Association that all 63 cities accept it. The proposal is as follows:

  1. The municipalities will pay 80% of any balance owing to DJJ as of May 31, 1999, (see Attachment). DJJ will forgive the remaining 20% owed.

  2. Payments are to be made by the municipalities to DJJ between July 1 and July 30, 1999.

  3. If a municipality does not pay the discounted balance by July 30, DJJ will move forward with the issuance of certificates of delinquency requiring the State Treasurer to divert any state source revenues for that municipality to DDJJ.

  4. Municipalities will be responsible for payment in full of billed amounts by DJJ for the period beginning June 1, 1999.

  5. The appeal to the Supreme Court and the lawsuit against DJJ will be dismissed.

The proposed settlement will become effective only if all 63 cities agree to these terms.

The proposed settlement, will reduce the City of North Augusta’s liability from $31,094.27 to $24,875.42.

ITEM 13. PARKS AND RECREATION: NIKE PEACH JAM CLINIC AND BASKETBALL TOURNAMENT - RECOGNITION BY COUNCIL

Councilmember Sullivan and Mayor Jones commended the Parks and Recreation staff for their excellent job in the presentation and running of the Nike Peach Jam basketball tournament held in the Riverview Park Activities Center.

ITEM 14. PARKS AND RECREATION: NORTH AUGUSTA BASEBALL TEAMS - RECOGNITION BY COUNCIL

Councilmember Carpenter and Mayor Jones commended the youth baseball teams of North Augusta for their excellence in representing the City of North Augusta.

The following teams advanced to state tournaments.

  1. Dixie Youth 10 year olds coached by C.F. Johnson

  2. Dixie Boys 13 year olds coached by Rick Meyer

  3. Dixie Boys 14 year olds coached by Mark Collins

  4. Dixie Majors 17 & 18 year olds coached by Vic Radcliffe

ITEM 15. PERSONNEL: CITY CLERK - APPOINTMENT

Upon the recommendation of the City Administrator and on motion by Mayor Jones, second by Councilmember Baggott, Council unanimously appointed Donna B. Young as City Clerk of North Augusta.

With the June 25, 1999 resignation of Leona Lewis Rogers the position of City Clerk has been vacant. Section 2-170 of the City Code states, "There shall be an officer of the City known as the City Clerk, who shall be appointed by the Council upon recommendation of the City Administrator." There is no definitive term. The City Clerk serves at the pleasure of the City Council. The City Administrator recommended to City Council the appointment of Donna B. Young as City Clerk. Mrs. Young was recently employed as executive secretary to Mayor and City Council, City Administrator, and Finance Director.

ITEM 16. PERSONNEL: EMPLOYEE RECOGNITION - SIMON JOHNSON - 31 YEARS OF SERVICE

On July 6, 1999, Simon Johnson, Heavy Equipment Operator I in the Sanitation Services Department retired with 31 years of service. On behalf of City Council and the City of North Augusta, Mayor Jones recognized and honored Mr. Simon Johnson for those years of service to the City of North Augusta by presenting him with a key to the City.

ITEM 17. PERSONNEL: EMPLOYEE OF THE QUARTER - APRIL, MAY, AND JUNE, 1999 - PRESENTATION

Mayor Jones presented the Employee of the Quarter award to George Childs, Foreman of the Material Recovery Facility. George was selected as Employee of the Quarter for April, May, and June, 1999, by the Employee Recognition Committee.

George was nominated by Sonya Lindley, Superintendent of Public Works, Sanitation.

George has been described as a hard worker who is forever willing to go that extra mile. When the Material Recover Facility was without a Supervisor or Foreman, George offered his services, working wonders with the facility. George never fails to pitch in wherever needed, never complains, and takes great pride in his work. He is respected by his co-workers and the inmates for his dedicated and hard work.

George has been with the City for five years. He was formerly in the Utilities Department.

ITEM 18. PUBLIC SAFETY: ASSISTANCE IN AUGUSTA SOUTHERN NATIONAL DRAG BOAT RACES

Councilmember McDowell and Mayor Jones commended Chief T. Lee Wetherington, Director of Public Safety of North Augusta, and his department for their assistance in the Augusta Southern National Drag Boat Races held the weekend of July 17th, 1999.

ITEM 19. PUBLIC SAFETY: CAPTAIN CHARLES WILLIAMS - FBI ACADEMY

Councilmember Sullivan and Mayor Jones commended Captain Charles Williams on his recent graduation from the FBI Academy.
