ORDER OF BUSINESS
The regular meeting of February 21, 2000, having been duly publicized, was called to order at 7:00 P. M. by Mayor Jones.
Reverend Bobby G. Hankerson of Hammond Grove Baptist Church rendered the invocation and Mayor Jones led in the Pledge of Allegiance.
Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, Mottel, Sullivan, and Smith.
Also in attendance were Charles B. Martin, City Administrator; Bob Brooks, Director of Parks, Recreation, and Leisure Services; John P. Potter, Jr., Director of Finance; T. Lee Wetherington, Director of Public Safety; Thomas C. Zeaser, Director of Engineering/Public Works; Donna B. Young, City Clerk, and Steve Matthews of Sinkler and Boyd, P.A.
The minutes of the regular meeting and study session meeting of February 7, 2000 were approved as submitted by general consent.
ITEM 1. ZONING: 1725 AND 1729 Marion Avenue – 0.43 ± Acres – C-3, General Commercial, to R-4, Multi-Family Residential – Ordinance – Third and Final Reading
On motion by Councilmember Baggott, second by Councilmember Mottel, Council unanimously adopted on third and final reading an ordinance to amend the zoning map of the City of North Augusta by rezoning 0.43 ± acres, located at 1725 and 1729 Marion Avenue, from C-3, General Commercial, to R-4, Multi-Family Residential.

ITEM 2. FINANCE: South Carolina Electric and Gas Company – Electric Services, Ordinance - First Reading
On motion by Councilmember Sullivan, second by Councilmember Smith, Council unanimously passed on first reading an ordinance granting to South Carolina Electric and Gas Company non-exclusive franchise rights to use publicly owned rights-of-way for the purpose of providing electric services within the City of North Augusta.

ORDINANCE NO. 2000-02
ADOPTING AN AGREEMENT GRANTING
SOUTH CAROLINA ELECTRIC AND GAS COMPANY
NON-EXCLUSIVE FRANCHISE RIGHTS
TO USE PUBLICLY OWNED RIGHTS-OF-WAY
FOR THE PURPOSE OF PROVIDING ELECTRIC SERVICE
WITHIN THE CITY OF NORTH AUGUSTA
WHEREAS, South Carolina Electric and Gas Company (SCE&G) presently holds a franchise issued in 1980 by the then Mayor and City Council for the City of North Augusta granting permission for the Company to provide electric services within the corporate limits and to use the City’s publicly owned rights-of-way to do so. Said franchise expires April 24, 2000; and
WHEREAS, South Carolina Electric and Gas Company (SCE&G) has requested that a new franchise agreement be issued allowing the company to continue to use the City’s publicly owned rights-of-way to provide electric services within the City; and
WHEREAS, Mayor and City Council have determined that it is in the City’s best interest to grant SCE&G a new franchise.
NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL FOR THE CITY OF NORTH AUGUSTA IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:
A non-exclusive franchise is hereby granted to South Carolina Electric and Gas Company conveying to said company the rights to use the City’s publicly owned rights-of-way for the purpose of providing electric services to the citizens of North Augusta. This non-exclusive franchise is granted in accordance with the terms contained in the franchise agreement which is attached hereto and made a permanent part hereof.
BE IT FURTHER ORDAINED that the City Administrator is authorized to sign the franchise agreement on behalf of the City and in accordance with this ordinance.
ITEM 3. FINANCE: South Carolina Electric and Gas Company – Electric Services – Ordinance - Second Reading
On motion by Mayor Jones, second by Councilmember Mottel, Council unanimously passed on second reading an ordinance granting to South Carolina Electric and Gas Company non-exclusive franchise rights to use publicly owned rights-of-way for the purpose of providing electric services within the City of North Augusta to South Carolina Electric and Gas Company.

ITEM 4. FINANCE: Aiken Electric Cooperative, Inc. – Electric Services – Ordinance - First Reading
On motion by Councilmember Carpenter, second by Councilmember McDowell, Council unanimously passed on first reading an ordinance granting to Aiken Electric Cooperative, Inc. non-exclusive franchise rights to use publicly owned rights-of-way for the purpose of providing electric services within the City of North Augusta.

On motion by Mayor Jones, second by Councilmember Smith, Council unanimously passed on second reading an ordinance granting to South Carolina Electric & Gas Company non-exclusive franchise rights to use publicly owned rights-of-way for the purpose of providing gas services within the City of North Augusta.

ITEM 8. FINANCE: Tax Increment Financing - Consolidated School District vs. City of North Augusta – Legal Briefing – Executive Session
In compliance with South Carolina Code of Laws, Section 30-4-70 (a)(2), upon the request of Steve Matthews of Sinkler and Boyd, P.A. and on motion by Councilmember Baggott, second by Councilmember Carpenter, Council voted unanimously to go into executive session for the purpose of receiving a briefing on the above referenced case by bond counsel, Steve Matthews of Sinkler and Boyd, P.A. Upon conclusion of the executive session Council reconvened and took the action recorded in Item #9 below.
ITEM 9. FINANCE: Tax Increment Financing - Consolidated School District vs. City of North Augusta – Motion
On motion by Councilmember Sullivan, second by Councilmember McDowell, Council unanimously passed a motion giving Steve Matthews of Sinkler and Boyd, P.A. authority to enter into negotiations with the Consolidated School District of Aiken County on behalf of the City of North Augusta for the purpose of settling the School District suit against the City involving the City’s Tax Increment Finance District.
ITEM 10. COUNCIL – Special Called Meeting – Wednesday, February 23, 2000 – 7:00 P. M.
A special meeting of City Council was called for 7:00 p.m. on Wednesday, February 23, 2000 for the purpose of receiving a legal briefing from the City’s Bond Counsel, Steve Matthews of Sinkler and Boyd, P.A. regarding settlement negotiations on The Consolidated School District Vs. City of North Augusta and to take any needed formal actions associated therewith.
There being no further business, Council adjourned.
