ORDER OF BUSINESS

The regular meeting of March 20, 2000, having been duly publicized, was called to order at 7:00 P. M. by Mayor Jones.

Mark Miskovic, a graduate student of Victory Baptist Church College, rendered the invocation and Mayor Jones led in the Pledge of Allegiance.

Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, Sullivan, and Smith. Councilmember Mottel was absent due to sickness.

Also in attendance were Charles B. Martin, City Administrator; Kelly Zier, City Attorney; Bob Brooks, Director of Parks, Recreation, and Leisure Services; George M. Grkovic, Director of Economic and Community Development; John P. Potter, Jr., Director of Finance; T. Lee Wetherington, Director of Public Safety; Thomas C. Zeaser, Director of Engineering/Public Works; and Donna B. Young, City Clerk.

The minutes of the regular meeting of March 6, 2000 and study session meeting of March 6, 2000 were approved as submitted by general consent.

ITEM 1. ANNEXATION: FIVE NOTCH ROAD – 3.5 ± ACRES – Property of Hammond Grove Baptist Church – Ordinance – Third and Final Reading

On motion by Councilmember Carpenter, second by Councilmember Baggott, Council unanimously passed on third and final reading an ordinance to effect the annexation of 3.5 ± acres located on Five Notch Road by Hammond Grove Baptist Church. The property to be annexed will be zoned R-3, Single-Family Residential.

ITEM 2. ECONOMIC AND COMMUNITY DEVELOPMENT: Comments by Jeanne McDaniel

Jeanne McDaniel expressed her concerns regarding the area zoned C-1 on Georgia Avenue and East Martintown Road. Mr. Skip Grkovic, Director of Economic and Community Development, informed Ms. McDaniel that the City of North Augusta has no tree preservation ordinance, and that the C-1 property owners may clear trees from their property, but a site plan approval requires property owners to install replacement trees.

ITEM 3. ECONOMIC AND COMMUNITY DEVELOPMENT: MUROOKA PROPERTY BILLBOARD – Ordinance, First Reading

On motion by Councilmember Sullivan, second by Councilmember Smith, Council unanimously passed on first reading an ordinance approving a Lease Agreement between Lamar Advertising and the City for an existing non-conforming billboard located on City owned property in the Central Riverfront District..

ORDINANCE NO. 2000-07

AUTHORIZING A LEASE AGREEMENT BETWEEN

LAMAR ADVERTISING AND

THE CITY OF NORTH AUGUSTA

FOR A BILLBOARD LOCATED ON THE

CITY OWNED MUROOKA PROPERTY

 

WHEREAS, the City of North Augusta took title to the 10.87 +/- acre Murooka property on January 31, 2000 upon which there exists a billboard previously managed by Lamar Advertising Company, and

WHEREAS, the subject billboard is non-conforming and, in compliance with City of North Augusta Zoning and Development Standards, must be removed by September 15, 2002, and

WHEREAS, Lamar Advertising has requested permission to continue to utilize the billboard until September 15, 2002 and has proposed a lease agreement for this purpose, and

WHEREAS, the Mayor and City Council find it in the best interest of the City to allow the billboard to remain until September 15, 2002 with Lamar Advertising Company managing the structure.

NOW THEREFORE BE IT ORDAINED by the Mayor and City Council for the City of North Augusta in meeting duly assembled and by the authority thereof that the attached lease agreement setting forth the terms and conditions of leasing the Murooka property billboard to Lamar Advertising Company is hereby approved.

BE IT FURTHER ORDAINED that the City Administrator is hereby authorized to sign the lease agreement on behalf of the City of North Augusta.

On motion by Mayor Jones, second by Councilmember Carpenter, Council unanimously passed on second reading an ordinance approving a Lease Agreement between Lamar Advertising and the City for an existing non-conforming billboard located on City owned property in the Central Riverfront District.

ITEM 5. PARKS, RECREATION, & LEISURE SERVICES: 12 AND UNDER GIRLS BASKETBALL TOURNAMENT TEAM – SC Recreation and Parks Association – 2000 State Champions - Recognition

The 12 and under Girls Basketball Tournament Team representing Parks, Recreation, and Leisure Services from North Augusta advanced from the District level to the State competition level to become the 2000 State Champions. Mayor Jones recognized the following team members and coaches:

ITEM 6. STREETS AND DRAINS: ROBIN LAKE VILLAGE, SECTION II, SUBDIVISION – Deed of Dedication – Resolution to Accept

On motion by Councilmember Baggott, second by Councilmember Carpenter, Council unanimously adopted a resolution accepting a deed of dedication to the streets, storm drainage systems, and associated easements in Robin Lake Village, Section II, Subdivision.

The resolution text is as follows:

RESOLUTION NO. 2000-2

ACCEPTING A DEED OF DEDICATION FOR THE STREETS,

STORM DRAINAGE SYSTEM,

AND ALL RIGHTS-OF-WAY AND EASEMENTS,

ALONG WITH A MAINTENANCE GUARANTEE AND LETTER OF CREDIT,

IN ROBIN LAKE VILLAGE, SECTION II, SUBDIVISION

 

WHEREAS, Lakes and Streams Development Co., developed Robin Lake Village, Section II, Subdivision according to the requirements of the North Augusta Planning Commission and the City, and owns the streets, utilities, and easements; and

WHEREAS, it is the policy of the City that, upon receiving final plat approval from the Planning Commission, the City will, following inspection by the City's Engineering Department, accept a deed of dedication for the streets, utilities, etc. for the purpose of ownership and maintenance when said deed is accompanied by a maintenance guarantee; and

WHEREAS, Lakes and Streams Development Co., has prepared a deed of dedication for certain improvements to be deeded over to the City of North Augusta; and

WHEREAS, a maintenance guarantee and letter of credit accompanies the deed; and

WHEREAS, the City Engineer has made final inspections of the subject improvements, and these improvements do meet City standards.

NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, do hereby accept a deed of dedication for:

All that certain piece, parcel or roadway situate, lying and being in Section 2 of Robin Lake in the Lakes and Streams Subdivision, in the City of North Augusta, County of Aiken, State of South Carolina, and being known and designated as Swallow Lake Drive, and appurtenances to said premises belonging or in any way incident or appertaining as shown on a plat of Section 2, Robin Lake, prepared for Lakes & Streams Development co., A South Carolina Corporation, by Southern Partners, Inc. dated September 7, 1999, revised October 11, 1999 and October 20, 1999, and recorded in Plat Book 39 at Page 252, Records of the RMC for Aiken County, which said plat is incorporated herein by reference thereto for a more complete and accurate description as to metes, bounds and location.

Also all drainage systems and utility easements as are more fully depicted on the plat aforesaid.

This is a portion of the identical property conveyed to Lakes & Streams Development Company, Inc., by deeds recorded in Title Book 1295, Pages 20, 24, 28, 32, 36, 40, 44, 48, 52, and 60, Records of the RMC for Aiken County, South Carolina.

A PORTION OF TAX PARCEL NO. 00-034-01-001

BE IT FURTHER RESOLVED that a Maintenance Guarantee and Letter of Credit valued at $20,000.00 are hereby accepted.

ITEM 7. STREETS AND DRAINS: THE VILLAGE AT RIVERVIEW SUBDIVISION – Deed of Dedication – Resolution to Accept

On motion by Councilmember Sullivan, second by Councilmember McDowell, Council unanimously adopted a resolution accepting a deed of dedication to the streets, sewer and storm drainage systems, water systems, fire mains, hydrants, and associated easements in The Village at Riverview Subdivision.

RESOLUTION NO. 2000-3

ACCEPTING A DEED OF DEDICATION FOR THE STREETS, WATER SYSTEM,

SANITARY SEWER SYSTEM, STORM DRAINAGE SYSTEM,

AND ALL RIGHTS-OF-WAY AND EASEMENTS,

ALONG WITH A MAINTENANCE GUARANTEE AND LETTER OF CREDIT,

IN THE VILLAGE AT RIVERVIEW SUBDIVISION

 

WHEREAS, Homesites, Ltd., developed The Village at Riverview Subdivision according to the requirements of the North Augusta Planning Commission and the City, and owns the streets, utilities, and easements; and

WHEREAS, it is the policy of the City that, upon receiving final plat approval from the Planning Commission, the City will, following inspection by the City's Engineering Department, accept a deed of dedication for the streets, utilities, etc. for the purpose of ownership and maintenance when said deed is accompanied by a maintenance guarantee; and

WHEREAS, Homesites, Ltd., has prepared a deed of dedication for certain improvements to be deeded over to the City of North Augusta; and

WHEREAS, a maintenance guarantee and letter of credit accompanies the deed; and

WHEREAS, the City Engineer has made final inspections of the subject improvements, and these improvements do meet City standards.

NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, do hereby accept a deed of dedication for:

All of the drinking water lines, easements for same and drinking water systems as exist in The Village at Riverview Subdivision, all of the streets in The Village at Riverview Subdivision, specifically identified as Village Parkway, 0.11 acres shown and designated as such and located at the Northwestern end of what is shown as "Mokateen St.", and 0.28 acres shown and designated as such and located on what is shown as "Village Parkway" all as shown on a plat prepared for Crowell & Co., Inc. by Southern Partners, Inc., dated 9/10/99, revised 10/11/99, revised 11/2/99, being recorded in the RMC Office of Aiken County, South Carolina in Plat Book 39, at Page 257.

Also included are the sanitary sewer and storm water systems, fire mains and hydrants, and easements for same, and all other such public improvements, as shown on the above referenced plat.

This is a portion of Tax Map 10-013-0-01-009 and a portion of Tax Map 00-009-1-06-002.

This is a portion of the property acquired by deed recorded in Book 1890 at Page 202 and a portion of the property acquired by deed recorded in Book 1890 at Page 206.

This is a portion of the property acquired by deed recorded in Book 1324, Page 121.

BE IT FURTHER RESOLVED that a Maintenance Guarantee and Letter of Credit valued at $36,000.00 are hereby accepted.

ITEM 8. STREETS AND DRAINS: WALNUT GROVE, SECTION FIVE, SUBDIVISION – Deed of Dedication – Resolution to Accept

On motion by Councilmember Smith, second by Councilmember Carpenter, Council unanimously adopted a resolution accepting a deed of dedication to the streets, sewer and storm drainage systems, and associated easements in Walnut Grove, Section Five, Subdivision.

ACCEPTING A DEED OF DEDICATION FOR THE STREETS,

SANITARY SEWER SYSTEM, STORM DRAINAGE SYSTEM,

AND ALL RIGHTS-OF-WAY AND EASEMENTS,

ALONG WITH A MAINTENANCE GUARANTEE AND LETTER OF CREDIT,

IN WALNUT GROVE, SECTION FIVE, SUBDIVISION

 

WHEREAS, Homesites, Ltd., developed Walnut Grove, Section Five, Subdivision according to the requirements of the North Augusta Planning Commission and the City, and owns the streets, utilities, and easements; and

WHEREAS, it is the policy of the City that, upon receiving final plat approval from the Planning Commission, the City will, following inspection by the City's Engineering Department, accept a deed of dedication for the streets, utilities, etc. for the purpose of ownership and maintenance when said deed is accompanied by a maintenance guarantee; and

WHEREAS, Homesites, Ltd., has prepared a deed of dedication for certain improvements to be deeded over to the City of North Augusta; and

WHEREAS, a maintenance guarantee and letter of credit accompanies the deed; and

WHEREAS, the City Engineer has made final inspections of the subject improvements, and these improvements do meet City standards.

NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, do hereby accept a deed of dedication for:

All of the streets in Walnut Grove, Section Five, Subdivision, specifically identified as St. Julian Place, as shown on a plat prepared for Homesites, Ltd. by Southern Partners, Inc., dated June 21, 1999, being recorded in the RMC Office of Aiken County, South Carolina, in Plat Book 39, Page 119.

Also included are the sanitary sewer and storm water systems, and easements for same, and all other such public improvements, excepting therefrom the water lines simultaneously conveyed to Edgefield County, South Carolina, all as shown on the above referenced plat.

This is a portion of Tax Map 00-015-01-080.

This is a portion of the property acquired by deed recorded in Book 1324, Page 121.

BE IT FURTHER RESOLVED that a Maintenance Guarantee and Letter of Credit valued at $30,900.00 are hereby accepted.
