PUBLIC HEARING
The Public Hearing of May 1, 2000, having been duly publicized, was called to order at 7:00 P. M. by Mayor Jones.
ITEM 1. PUBLIC SAFETY: 1999 BJA Local Law Enforcement Block Grant
The Public Hearing for the purpose of receiving public comment on a proposed block Grant from the Bureau of Justice Administration commenced.
Chief T. Lee Wetherington, Director of Public Safety, advised Mayor and Council that The Department of Public Safety had been approved for a 1999 Bureau of Administration Local Law Enforcement Block Grant in the amount of $19,490. This grant requires a local match of $2,166 providing a total project amount of $21,656. Both the grant and the local match were anticipated and are included within the current budget. This grant will be used for the purchase of equipment needed within the department.
As required by the grant guidelines, a Citizens’ Review Committee has met, reviewed and approved the requested equipment. Members of the Citizens’ Review Committee were: Barry Head, Tom Murphy, Mark Powers, and Kelly Zier.
ORDER OF BUSINESS
The regular meeting of May 1, 2000, having been duly publicized, was called to order at 7:00 P. M. by Mayor Jones.
Pastor Albert James, of Second Providence Methodist Church rendered the invocation and Mayor Jones led in the Pledge of Allegiance.
Members present were Mayor Jones and Councilmembers Carpenter, McDowell, Mottel, Smith, and Sullivan. Councilmember Baggott was absent due to work.
Also in attendance were Charles B. Martin, City Administrator; Kelly Zier, City Attorney; Bob Brooks, Director of Parks, Recreation, and Leisure Services; George M. Grkovic, Director of Economic and Community Development; John P. Potter, Jr., Director of Finance; T. Lee Wetherington, Director of Public Safety; Thomas C. Zeaser, Director of Engineering/Public Works; and Donna B. Young, City Clerk.
The minutes of the regular meeting of April 17, 2000 and study session meeting of April 17, 2000 were approved as submitted by general consent.
ITEM 1. ANNEXATION: 704 E. Martintown Road – 0.22 ± Acres – Petition, Resolution to Accept
On motion by Councilmember McDowell, second by Councilmember Mottel, Council adopted a resolution accepting a petition to annex 0.22 ± acres of land located on 704 E. Martintown Road.
The resolution text is as follows:
RESOLUTION NO. 2000-11
TO ACCEPT PETITION FOR ANNEXATION OF
0.22 ± ACRES OF LAND LOCATED AT 704 E. MARTINTOWN ROAD
WHEREAS, Section 5-3-150 of the Code of Laws of the State of South Carolina provides that: "Any area or property which is contiguous to a city or town may be annexed to the city or town by filing with the municipal governing body a petition signed by seventy-five percent or more of the freeholders owning at least seventy-five percent of the assessed valuation of the real property in the area requesting annexation. Upon the agreement of the governing body to accept the petition and annex the area, and the enactment of an ordinance declaring the area annexed to the city or town, the annexation shall be complete;" and
WHEREAS, the governing body of the City of North Augusta determines it to be in the best interest of the City to accept a petition for annexation attached hereto dated March 13, 2000 of the property described below:
All those certain pieces, parcels or tracts of land, with improvements thereon, situated, lying and being in the County of Aiken, State of South Carolina, adjacent to the present City Limits of North Augusta, identified as a portion of Tax Parcel Number 10-053-0-04-012 which is outside the City Limits of North Augusta, such lot being shown on a plat prepared by City of North Augusta, said plat being titled "Plat of Property (704 E. Martintown Road) Sought To Be Annexed To The City of North Augusta," dated March 3, 2000, and identified as Exhibit "A."
Said property is identified by the following tax map parcel number:

NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of North Augusta in meeting duly assembled and by the authority thereof that the` Petition to Annex the property described herein is hereby accepted.

ITEM 2. ANNEXATION: 704 E. Martintown Road – 0.22 ± Acres – Amendment to Ordinance No. 2000-09
On motion by Mayor Jones, second by Councilmember Sullivan, Ordinance No. 2000-9 was amended to include herein the right-of-way of Old Martintown Road which fronts on the property being annexed. The right-of-way of East Martintown Road was not included in this annexation because it is separated by private property not a part of the annexation request. The Amendment to the Ordinance No. 2000-09 passed unanimously.
ITEM 3. ANNEXATION: 704 E. Martintown Road – 0.22 ± Acres – Ordinance, First Reading
On motion by Councilmember Smith, second by Councilmember Carpenter, Council unanimously passed on first reading an ordinance to effect the annexation of 0.22 ± acres of land located on 704 E. Martintown Road. Also, included in this annexation is the full right-of-way of Old Martintown Road which fronts on the property being annexed. The property to be annexed shall be zoned C-3, General Commercial.

BY ANNEXING 0.22 ± ACRES OF LAND LOCATED AT 704 E. MARTINTOWN ROAD

II. In conformance with the City’s Land Use and Development Plan, the property shall be zoned C-3, General Commercial, as shown on the plat attached hereto titled Exhibit "B" titled "Plat of Property (Zoning) (704 E. Martintown Rd.) Sought to be Annexed to the City of North Augusta.
III. All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
IV. This Ordinance shall become effective immediately upon its adoption on third reading.

On motion by Mayor Jones, second by Councilmember Carpenter, Council unanimously passed on second reading an ordinance to effect the annexation of 0.22 ± acres of land located on 704 E. Martintown Road. Also, included in this annexation is the full right-of-way of Old Martintown Road which fronts on the property being annexed. The property to be annexed shall be zoned C-3, General Commercial.

ITEM 5. PERSONNEL: Employee Recognition – Henry Broadwater – 30 Years of Service
Mayor Jones recognized Henry Broadwater for his 30 years of continued dedicated service to the City of North Augusta. Mr. Broadwater will retire from the City of North Augusta on May 13, 2000. He was presented with a key to the City. Henry is a Trades Worker in the Streets and Drains Department.
ITEM 6. PARKS, RECREATION, & LEISURE SERVICES: Request of David Mode – Dog Leash Law
David Mode requested that Council review their policy regarding the dog on leash policy at Riverview Park. Mr. Mode’s dog entertains at soccer half-time shows and is extremely well behaved. He had been cited for not having his dog on a leash. It was the consensus of Council that Council would explore a solution to this situation, although it was noted that the leash law could not be ignored. Council directed Bob Brooks, Director of Parks, Recreation, and Leisure Services, to look further into this matter and report back to Council.
