ORDER OF BUSINESS

 

The regular meeting of May 15, 2000, having been duly publicized, was called to order at 7:00 P.M. by Mayor Jones.

 Father David Thompson of St. Bartholomew Episcopal Church rendered the invocation and Mayor Jones led in the Pledge of Allegiance.

Members present were Mayor Jones and Councilmembers Baggott, McDowell, Mottel, Smith, and Sullivan. Councilmember Carpenter was absent.

 

Also in attendance were Charles B. Martin, City Administrator; Kelly Zier, City Attorney; Bob Brooks, Director of Parks, Recreation, and Leisure Services; George M. Grkovic, Director of Economic and Community Development; T. Lee Wetherington, Director of Public Safety; Thomas C. Zeaser, Director of Engineering/Public Works; and Donna B. Young, City Clerk.

 The minutes of the regular meeting of May 1, 2000 and study session meeting of May 1, 2000 were approved as submitted by general consent.

 ITEM 1. ANNEXATION: 704 E. Martintown Road – 0.22 ± Acres – Ordinance, Third and Final Reading

 On motion by Councilmember Mottel, second by Councilmember McDowell, Council unanimously passed on third and final reading an ordinance to effect the annexation of 0.22 ± acres of land located on 704 E. Martintown Road. Also, included in this annexation is the full right-of-way of Old Martintown Road which fronts on the property being annexed. The property to be annexed shall be zoned C-3, General Commercial.

 ITEM 2. COMMUNITY PROMOTION: Aiken County Teen Pregnancy Council

 Councilmember Kent Sullivan praised Chief Lee Wetherington for his participation in a South Carolina law seminar on "Under-aged Sex: What Everyone Needs to Know" hosted by the Aiken County Teen Pregnancy Prevention Council on May 8, 2000.

 ITEM 3. COMMUNITY PROMOTION: North Augusta High School Golf Team

 Mr. Bill Griffin, who resides at 1826 Bolin Road, North Augusta, South Carolina, praised the North Augusta High School Golf Team for being the runner up in the State Championships.

 ITEM 4. FINANCE: Franchise Agreement – Comcast Cablevision of Georgia/South Carolina, Inc. – Ordinance, First Reading

 On motion by Councilmember Baggott, second by Councilmember Smith, Council unanimously passed on first reading an ordinance granting to Comcast Cablevision of Georgia/South Carolina, Inc. non-exclusive rights to use publicly owned rights-of-way for the purpose of providing cablevision and cable related services within the City of North Augusta, South Carolina.

ADOPTING A FRANCHISE AGREEMENT GRANTING

COMCAST CABLEVISION OF GEORGIA/SOUTH CAROLINA, INC.

NON-EXCLUSIVE FRANCHISE RIGHTS

TO USE PUBLICLY OWNED RIGHTS-OF-WAY

FOR THE PURPOSE OF PROVIDING

CABLEVISION AND RELATED SERVICES

WITHIN THE CITY OF NORTH AUGUSTA

 

WHEREAS, Comcast Cablevision of Georgia/South Carolina, Inc. (Comcast) has requested that a new franchise agreement be issued allowing the company to continue to use the City’s publicly owned rights-of-way to provide cablevision and related services within the City; and

 WHEREAS, Mayor and City Council have determined that it is in the City’s best interest to grant Comcast Cablevision of Georgia/South Carolina, Inc. a new franchise.

 NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL FOR THE CITY OF NORTH AUGUSTA IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:

 A non-exclusive franchise is hereby granted to Comcast Cablevision of Georgia/South Carolina, Inc. conveying to said company the rights to use the City’s publicly owned rights-of-way for the purpose of providing cablevision and related services to the citizens of North Augusta. This non-exclusive franchise is granted in accordance with the terms contained in the franchise agreement which is attached hereto and made a permanent part hereof.

BE IT FURTHER ORDAINED that the City Administrator is authorized to sign the franchise agreement on behalf of the City and in accordance with this ordinance.

 DONE, RATIFIED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, ON THIS ______ DAY OF __________________, 2000.

 

ITEM 5. FINANCE: Franchise Agreement – Comcast Cablevision of Georgia/South Carolina, Inc. – Ordinance, Second Reading

On motion by Mayor Jones, second by Councilmember Sullivan, Council unanimously passed on second reading an ordinance granting to Comcast Cablevision of Georgia/South Carolina, Inc. non-exclusive rights to use publicly owned rights-of-way for the purpose of providing cablevision and cable related services within the City of North Augusta, South Carolina.

 ITEM 6. FINANCE: Franchise Agreement – Knology of Augusta, Inc. – Amendment to Ordinance No. 2000-11

 On motion by Mayor Jones, second by Councilmember Mottel, Council unanimously passed a motion to amend Ordinance No. 2000-11 by striking the words "to continue" in the first paragraph of the Ordinance to read as follows:

 WHEREAS, Knology of Augusta, Inc. (Knology) has requested that a franchise agreement be issued allowing the company to continue to use the City’s publicly owned rights-of-way to provide cablevision, telecommunications, and related services within the City; and

 ITEM 7. FINANCE: Franchise Agreement – Knology of Augusta, Inc. – Ordinance, First Reading

 

On motion by Mayor Jones, second by Councilmember McDowell, Council unanimously passed on first reading an ordinance granting to Knology of Augusta, Inc. non-exclusive rights to use publicly owned rights-of-way for the purpose of providing cablevision, telecommunications, and related services within the City of North Augusta, South Carolina.

 ITEM 8. FINANCE: Franchise Agreement – Knology of Augusta, Inc.– Ordinance, Second Reading

 On motion by Councilmember McDowell, second by Councilmember Mottel, Council unanimously passed on second reading an ordinance granting to Knology of Augusta, Inc. non-exclusive rights to use publicly owned rights-of-way for the purpose of providing cablevision, telecommunications, and related services within the City of North Augusta, South Carolina.

 ITEM 9. FINANCE: Capital Projects and Use Tax Commission – Member Appointment by City of North Augusta

 On motion by Mayor Jones, second by Councilmember Smith, Council unanimously passed the appointment of I. Kent Sullivan as a member of the Capital Projects and Use Tax Commission of Aiken County. This Commission’s purpose is to consider proposals for funding capital projects with proceeds from a one-(1) cent Capital Projects sales tax and to make recommendations to Aiken County Council.

 ITEM 10. STREET AND DRAINS: Intersection of Martintown Road at Georgia Avenue Repairs

 Councilmember Kent Sullivan requested an update regarding the repairs to the intersection of Martintown Road at Georgia Avenue. This area is maintained by the State. Tom Zeaser, Director of Engineering and Public Works, has previously requested that the South Carolina Department of Transportation schedule repairs to be made immediately. He has contacted them again regarding this issue, but has yet to hear from them. He will continue to follow-up on this matter.

 

ITEM 11. PUBLIC UTILITIES: Atomic Road and Five Notch Road Water Tower

 Councilmember Kent Sullivan praised the "new look" the Atomic Road and Five Notch Road water towers are sporting with the addition of the City’s logo.

 ITEM 12. PUBLIC UTILITIES: Water Usage

 Mayor Jones encouraged the citizens of North Augusta to "Water Smart" and conserve water during this dry spell.
