ORDER OF BUSINESS
The regular meeting of June 5, 2000, having been duly publicized, was called to order at 7:00 P.M. by Mayor Jones.
Mayor Lark Jones rendered the invocation and led in the Pledge of Allegiance.
Members present were Mayor Jones and Councilmembers Baggott, Carpenter, McDowell, Mottel, and Sullivan.
Also in attendance were Charles B. Martin, City Administrator; Kelly Zier, City Attorney; Bob Brooks, Director of Parks, Recreation, and Leisure Services; George M. Grkovic, Director of Economic and Community Development; John P. Potter, Jr., Director of Finance; T. Lee Wetherington, Director of Public Safety; Thomas C. Zeaser, Director of Engineering/Public Works; and Donna B. Young, City Clerk.
The minutes of the regular meeting of May 15, 2000 and Twentieth Annual North Augusta Forward 2000 meetings of May 18 and 19, 2000 were approved as submitted by general consent.
ITEM 1. COMMUNITY PROMOTION: Proclamation – National Management Week – June 5 – 9, 2000
The proclamation is as follows:
City of North Augusta, South Carolina
WHEREAS, responsible and resourceful management practices are key ingredients in the successful operation of the City of North Augusta’s government, businesses, and industry; and
WHEREAS, the National Management Association, with over 34,000 members nationwide, advocates sound management practices and is devoted to the success of our free enterprise system through the important contribution of its members’ talents and energies to ensure the smooth operation of government and business; and
WHEREAS, the National Management Association is the largest non-profit management organization in the United States; and
WHEREAS, the National Management Association is sponsoring the 21st Annual Management Week in America, highlighting its objectives to develop and recognize management as a profession and promote our American Competitive Enterprise System.
NOW THEREFORE, I, Lark W. Jones, Mayor of the City of North Augusta, South Carolina, do hereby proclaim June 5 - 9, 2000, as
NATIONAL MANAGEMENT WEEK
in the City of North Augusta, South Carolina, and encourage citizens to recognize the management profession and give their full support to this observance.

On motion by Councilmember McDowell, second by Councilmember Carpenter, Council received as information the resignation of Donald C. Smith as Councilmember of the City of North Augusta to accept his elected position to South Carolina House of Representatives District No. 83.
ITEM 3. ELECTIONS: Special Municipal Election – First Reading
On motion by Councilmember Baggott, second by Mayor Jones, Council unanimously passed on first reading an ordinance establishing dates for a Special Municipal Election to be held on November 7, 2000, for the election of one position on City Council to serve an unexpired term ending May 7, 2001.

CODE OF LAWS OF NORTH AUGUSTA, SOUTH CAROLINA,
BY SETTING THE DATES FOR MUNICIPAL PARTY PRIMARIES, CONVENTIONS,
AND SPECIAL ELECTION, TIMES FOR FILING OF NOMINATING PETITIONS,
CERTIFICATION OF CANDIDATES BY PARTIES, AND
CERTIFICATION OF CANDIDATES BY MUNICIPAL ELECTION COMMISSION
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF NORTH AUGUSTA, SOUTH CAROLINA, IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY THEREOF, THAT:
I. A Special Municipal Election for purpose of electing one member of City Council for the City of North Augusta, South Carolina, to fill a vacant term ending May 7, 2001, shall be Tuesday, November 7, 2000.
II. The filing and certification dates are hereby set for the 2000 Municipal Party Primaries and Special Election as follows:
B. Primary elections, if selected by a party, shall be held on August 15, 2000, with a run-off, if necessary, on August 29, 2000.
C. Conventions, if selected by a party, shall be held no later than August 15, 2000.
D. Nomination by petition shall commence at 12:00 Noon on August 15, 2000, and end at 12:00 Noon on August 22, 2000.
E. The deadline for parties to certify candidates selected by primary or convention to the Municipal Election Commission shall be 12:00 Noon, September 8, 2000.
F. The certification of the candidates by petition, primary, or convention by the Municipal Election Commission shall be no later than 12:00 Noon, September 11, 2000.
III. All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
ITEM 4. ELECTIONS: Special Municipal Election – Second Reading

ITEM 5. ELECTIONS: Special Called Meeting – June 12, 2000 – 7:00 p.m.
Mayor Jones called for a special called meeting of City Council to be held on June 12, 2000 at 7:00 p.m. for the purpose of considering Ordinance Number 2000-12 on third and final reading.
ITEM 6. FINANCE: Franchise Agreement – Comcast Cablevision of Georgia/South Carolina, Inc. – Ordinance, Third and Final Reading
On motion by Councilmember Sullivan, second by Councilmember Carpenter, Council unanimously adopted on third and final reading an ordinance granting to Comcast Cablevision of Georgia/South Carolina, Inc. non-exclusive rights to use publicly owned rights-of-way for the purpose of providing cablevision and cable related services within the City of North Augusta, South Carolina.

ITEM 7. FINANCE: Franchise Agreement – Knology of Augusta, Inc. – Ordinance, Third and Final Reading
On motion by Councilmember Phil Mottel, second by Councilmember Baggott, Council unanimously adopted on third and final reading an ordinance granting to Knology of Augusta, Inc. non-exclusive rights to use publicly owned rights-of-way for the purpose of providing cablevision, telecommunications, and related services within the City of North Augusta, South Carolina.

ITEM 8. PARKS, RECREATION, & LEISURE SERVCIES: Greeneway Extension – RiverNorth Subdivision – Deed of Dedication - Resolution
On motion by Councilmember McDowell, second by Councilmember Sullivan, Council unanimously adopted a resolution accepting a deed of dedication to the right-of-way for the RiverNorth Greeneway Extension across the northern portion of the wetlands area of the RiverNorth property adjacent to the Railroad right-of-way in the RiverNorth Subdivision.

OF THE RIVERNORTH PROPERTY
ADJACENT TO THE RAILROAD RIGHT-OF-WAY
IN THE RIVERNORTH SUBDIVISION
WHEREAS, Riverside Partners, LP, developed The RiverNorth, Phase II Subdivision according to the requirements of the North Augusta Planning Commission and the City, and
WHEREAS, as part of the approved development plan, Riverside Partners, LP, agreed to grant the right-of-way for the Greeneway extension across the northern portion of the wetlands area of the RiverNorth property adjacent to the railroad right-of-way; and
WHEREAS, Riverside Partners, LP, has prepared a deed of dedication for these properties to be deeded over to the City of North Augusta; and
NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, do hereby accept a deed of dedication for:
FIRST: ALL That certain piece, parcel or lot of land, containing 0.804 acres, more or less, situate, lying and being in the City of North Augusta, in Aiken County, South Carolina, and being shown and designated as Parcel "A" on a plat prepared by Robert L. Herrington, Jr., R.L.S., dated April 28, 2000, to be recorded herewith. Reference being made to said plat for a more complete description as to the metes and bounds thereof.
SECOND: ALL That certain piece, parcel or tract of land, containing 5.414 acres, more or less, situate, lying and being in the City of North Augusta, in Aiken County, South Carolina, and being shown and designated as Parcel "B" on a plat prepared by Robert L. Herrington, Jr., R.L.S., dated April 28, 2000, to be recorded herewith. Reference being made to said plat for a more complete description as to the metes and bounds thereof.
THIRD: ALL That certain piece, parcel or tract of land, containing 1.588 acres, more or less, situate, lying and being in the City of North Augusta, in Aiken County, South Carolina, and being shown and designated as Parcel "C" on a plat prepared by Robert L. Herrington, Jr., R.L.S., dated April 28, 2000, to be recorded herewith. Reference being made to said plat for a more complete description as to the metes and bounds thereof.

ITEM 10. STREET AND DRAINS: Intersection of East Martintown Road at Georgia Avenue Repairs
Tom Zeaser, Director of Engineering and Public Works, reported that the South Carolina Department of Transportation is scheduled to make pavement repairs at the intersection of East Martintown Road at Georgia Avenue on June 6, 2000. This area is maintained by the State who will be doing the repairs.
ITEM 11. STREETS AND DRAINS: RiverNorth, Phase II Subdivision – Deed of Dedication - Resolution
On motion by Mayor Jones, second by Councilmember Carpenter, Council unanimously adopted a resolution accepting a deed of dedication for the streets and utilities (water, sanitary sewer, and storm drainage systems) within the second phase of RiverNorth Subdivision.

RESOLUTION NO. 2000-12
SANITARY SEWER SYSTEM, STORM DRAINAGE SYSTEM,
AND ALL RIGHTS-OF-WAY AND EASEMENTS,
ALONG WITH A MAINTENANCE GUARANTEE AND LETTER OF CREDIT,
IN THE RIVERNORTH, PHASE II SUBDIVISION
WHEREAS, Riverside Partners, LP, developed The RiverNorth, Phase II Subdivision according to the requirements of the North Augusta Planning Commission and the City, and owns the streets, utilities, and easements; and
WHEREAS, it is the policy of the City that, upon receiving final plat approval from the Planning Commission, the City will, following inspection by the City's Engineering Department, accept a deed of dedication for the streets, utilities, etc. for the purpose of ownership and maintenance when said deed is accompanied by a maintenance guarantee; and
WHEREAS, Riverside Partners, LP, has prepared a deed of dedication for certain improvements to be deeded over to the City of North Augusta; and
WHEREAS, a maintenance guarantee and letter of credit accompanies the deed; and
WHEREAS, the City Engineer has made final inspections of the subject improvements, and these improvements do meet City standards.
NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof, do hereby accept a deed of dedication for:
FIRST: ALL Those certain streets, roadways, or highways known as RiverNorth Drive and Altamaha Drive, situate, lying and being in the City of North Augusta, in Aiken County, South Carolina, as are shown and designated on a plat of Section II of RiverNorth prepared by Robert L. Herrington, Jr., R.L.S., dated October 29, 1999, and revised November 9, 1999, to be recorded herewith. Reference being made to said plat for a more complete description as to the metes and bounds thereof.
SECOND: ALL Right, title and interest in and to the water system, sanitary sewer system, and storm sewer system within the right of way of RiverNorth Drive and Altamaha Drive and also installed within the easements pertaining thereto together with a non-exclusive right of access to and use of all such utility and drainage easements as are shown and designed on a plat of Section II of RiverNorth prepared by Robert L. Herrington, Jr., R.L.S., dated October 29, 1999, and revised November 9, 1999, to be recorded herewith. Reference being made to said plat for a more complete description to the metes and bounds thereof.
THIRD: ALL That certain piece, parcel or lot of land, containing 0.03 acres, more or less, with the sanitary sewer lift station improvements thereon, situate, lying and being in the City of North Augusta, in Aiken County, South Carolina, and being shown and designated as Parcel "A" on a plat of Section II of RiverNorth prepared by Robert L. Herrington, Jr., R.L.S., dated October 29, 1999, and revised November 9, 1999, to be recorded herewith. Reference being made to said plat for a more complete description as to the metes and bounds thereof.

ITEM 12. UTILITIES: Drought Response – Council Review
In compliance with state law the North Augusta City Council adopted a Drought Response Ordinance in 1987. The South Carolina Department of Natural Resources is now requesting that the City implement this ordinance.
Section IV of Ordinance 87-01 titled "Responses to Moderate, Severe, and Extreme Drought Alert Phases and Local Water Shortages" states:
"Levels of drought are moderate, severe, and extreme. Proclamations issued by the City of North Augusta should coordinate an appropriate response to the level of drought or water shortage which exists.
Proclamations setting forth responses to the various drought alert phases shall be made by the City of North Augusta and are to be based upon drought monitoring data and/or information from the Drought Response Committee, the South Carolina Water Resources Commission, and/or local conditions.
Moderate Drought Alert Phase: If conditions indicate that a moderate drought condition is present and is expected to persist, the City of North Augusta may proclaim a Moderate Drought Alert.
A fifteen percent (15%) voluntary water use reduction for agricultural, commercial, industrial, institutional, and electric power generation purposes.
A thirty percent (30%) voluntary water use reduction for residential customers.
General Responses:
Issue a Public Notice of Drought Conditions on water supply and demand in a newspaper of general circulation within the City of North Augusta and/or notify each water customer by mail or by other means. This statement should include a list of non-essential water uses and curtailment measurement.
A. Institute an increased water supply system maintenance effort to identify and correct leaks.
Encourage customers of the City of North Augusta to comply with the listed voluntary water-use restrictions in all categories while moderate drought conditions exist.
Water-Use Restrictions:
Agriculture, irrigation and livestock: Implement conservation techniques, explore different water-saving methods, and use alternative sources.
Commercial, industrial, and institutional: Reduce aesthetic, domestic, landscaping, and water-based recreational activities such as swimming pools, water slides, and other related water activities.
Electric power generation: Evaluate on an individual basis.
Residential: Encourage reduction in water use to 75 gallons per person per day, reduce domestic, landscaping, and water based recreational activities such as swimming pools, water slides, and other related water activities."
The City’s Voluntary Draft Response letter written in compliance with the declaration of "MODERATE" drought status by the South Carolina Department of Natural Resources is as follows:
VOLUNTARY DROUGHT RESPONSE
Dear North Augusta Water System Customer:
The South Carolina Department of Natural Resources has upgraded the drought status for Aiken and Edgefield Counties to "MODERATE." A "MODERATE" drought declaration means that drought conditions have continued to deteriorate and are expected to persist.
As customers of the North Augusta Water System, we are all fortunate to enjoy the benefits of an ample and dependable supply of water. The elected officials and administration of the City continually strive to keep our water system up to date with ample capacity. We are currently in the process of further increasing our water production capability by 75%.
To ensure that these benefits continue, we must all be concerned about how we use water during times of extreme heat and drought. Although household needs and fire-fighting needs are of first priority, outside water usage is important to our customers.
The demand for water has been steadily increasing each day during the current record heat and drought. This has caused the City’s water system to approach maximum capacity. To ensure that all of the needs of our customers continue to be met, we ask each customer to follow the guidelines below for the duration of the drought.
Please water lawns and shrubs ONLY during the hours of
5:00 a.m. to 8:00 a.m.
OR
5:00 p.m. to 9:00 p.m.
When you water outside, do so smartly.
Do not overwater.
