Meriwether Monument Opinion
The City of North Augusta has received an opinion from the South Carolina Attorney General’s Office regarding the applicability of the Heritage Act to the Meriwether Monument located in the City’s John Calhoun Park. The A.G.’s opinion, issued July 21, 2020 states, in summary:
- They possess no authority to determine whether the Heritage Act is applicable and no need to resolve the applicability
- The monument was erected pursuant to legislation enacted by the General Assembly in 1914-15 (Joint Resolution No. 540, S.C. Acts 946, and subsequently modified by Act No. 229, 1915 S.C. Acts 427)
- Only an act of the South Carolina Legislature may amend or repeal an Act
Having just received the A.G.’s opinion, the City of North Augusta has not yet determined the next steps to take regarding the Meriwether Monument.
